The Office of Clerk of the Circuit Court is established by the Indiana State Constitution to serve as the record keeper for the constitutionally created Court. The Clerk is elected by the registered voters of Washington County and is limited to serving two consecutive terms. The Clerk of the Circuit Court also serves as the Secretary to the County Election Board which is responsible for conducting all elections in the county including the certification of results.

The Clerk serves as trustee of child support collections ordered by the Court and paid through the Clerk’s Office, and also acts as the chief financial officer of the Courts by collecting, disbursing, and reconciling monies related to court cases. The Clerk collects filing fees, court costs, and judgment monies in civil and small claims cases. In criminal and infraction cases, the Clerk collects fees and fines for city, county, and state jurisdictions, deferral and pretrial diversion fees, bail bond monies, restitution and probation fees ordered by the Court. In Washington County, the Clerk also serves as a Passport Acceptance Agent.

CHILD SUPPORT

MAKING PAYMENTS: Indiana law requires your child support payments be made to the Indiana State Central Collection Unit, “INSCCU”. The INSCCU will accept payments in the form of Personal checks, Money orders, and Cashier’s checks (Do not send cash). When sending a child support payment to INSCCU, include the following information:

  • Your name
  • Your phone number
  • Last 4 digits of your social security #
  • Your address
  • Payment amount
  • Your ISETS case #
  • Your Court cause #
  • Custodial party’s name

A Child Support Remittance Form found at www.INSCCU.com may be downloaded, completed, printed and sent in with payment to the following address:

*Cash payments may still be accepted at the county clerk’s office during regular business hours M-F 8:00 am to 4:00 pm.

CHILD SUPPORT PAYMENT HISTORIES AVAILABLE: Child support payment histories may be obtained, with proof of identification, (Photo I.D. required). There is a $1.00 fee for each page. Certification is $1.00 extra. Questions relating to recent payments, disbursement, and court order information should be directed to INSCCU at 800-840-8757 or 317-241-9636 (TTY) Monday thru Friday 7:00 a.m. to 6:00 p.m. and Saturday from 7:00 a.m. to 12:00 p.m. (Automated phone service is also available 24 hours per day, seven days per week).

ANNUAL DOCKET FEE DUE: Under Indiana Law (IC 33-19-6-5), the payor is required to remit an annual docket fee of $55. This fee cannot be deducted from a child support payment and payor should specify remittance as annual docket fee.

CIVIL FILING DIVISION

To file a civil action case the following is required:

MARRIAGE LICENSES REQUIREMENTS

Where to Apply: Indiana residents must obtain a license in the county in which at least one of the applicants resides. Out of state residents must obtain a marriage license in the county in which the marriage will be performed. Both must apply in person together.

Fees: If at least one of the applicants is a resident of Washington County, the fee is $18 CASH at the time of application. If both applicants are non-residents, the fee is $60 CASH at the time of application. NO PERSONAL CHECKS WILL BE ACCEPTED.

Identification: Applicants must show proof of identification by a valid driver’s license or an original certified copy of their birth certificate. If these forms are not available a state-issued identification card, baptismal certificate with date of birth, military I.D., passport, life insurance policy with date of birth, school I.D., or transcripts of school records with date of birth may be accepted.

Waiting Period: A marriage license can be issued on the same day of application. There is no legal waiting period to obtain your marriage license. The license is valid for sixty (60) days from date of issuance during which time the marriage must be performed. You may request a certified copy, please allow two (2) weeks. Any additional copies for $1.00.

Age Requirements: Applicants must be 18 or older. Applicants age 17 must have parental consent. Applicants aged 15 and 16 must have a court order and parental consent.

Previous Marriages: If there have been any previous marriages, the application requires information of the month and year marriages ended as well as the manner (e.g., divorce, death, annulment). If you have been divorced for less than 60 days, you must provide a copy of the divorce decree.

PASSPORTS

All travelers must have their own U.S. Passport Book or U.S. Passport Card.
Application Form DS-11 may be obtained at the clerk’s office.

U.S. Passport Book: Valid for travel by air, sea or land. Valid for 10 yrs for adults; 5 yrs for minors.
You will need:·

  • A completed Application Form DS-11 (do not sign form until you appear before clerk’s personnel)
  • · 2 Recent Color Photographs: must be white background, full front view of face & hair, & measure 2x2 inches
  • · Proof of U.S. Citizenship: previous U.S. Passport or certified birth certificate if born inside the U.S.
  • · Proof of Identity: previous U.S. Passport; Driver’s License (not temporary or learner’s permit); or a government (Federal, State, municipal) employee identification card.
  • · Fees: $25.00 (Processing Fee)
    $75.00 (16 and above) payable to “U.S. Department of State”
    $60.00 (under 16) payable to “U.S. Department of State”
  • · Expedited Passport Fees:
    $25 (Processing Fee)
    $149.85 (16 and above) payable to “U.S. Department of State”
    $134.85 (under 16) payable to U.S. Department of State”
    + $16.50 additional fee for overnight mail

SMALL CLAIMS

Small Claim forms are available at the clerk’s office.

  • Filing fee:
    $76 Filing fee must be paid at time of filing.
    +$10 per each additional defendant.
    +$13 if service by sheriff.
  • $6,000 limit if plaintiff is an individual.
  • $1,500 limit if plaintiff is a corporation.
  • The claim may be filed in the county in which the defendant lives or where the transaction has taken place.
  • Upon filing the clerk will need the original Small Claim form and one copy per defendant, (service by certified mail); one (1) additional copy will be needed if service is by sheriff; plus one copy for your records.
  • You will be given a hearing date at time of filing.
  • Copy of any addition documentation for the court file.
  • You must have an address for defendant before service can be made.

TRAFFIC COURT DIVISION

The Washington County Clerk’s Office is responsible for receipting in the payments for the Traffic Violations Bureau or cases resolved in Criminal Court. When a ticket is issued by a police agency, the following steps are involved:
You have approximately 30 days from the day you receive the ticket to admit (pay) or deny the violation without penalty.
The payment is due on your appearance date. Failure to pay or deny the ticket by that date will result in a default judgment against you and suspension of your driver’s license; and/or issue a warrant for your arrest. The court may also assess an additional late payment fee of $25.00.
ADMISSION: You may admit the violation by signing back of ticket and submit with payment.
Payments may be made by cashier’s check or money order payable to WASHINGTON COUNTY CLERK, (NO PERSONAL CHECKS).
IF YOU CHOOSE TO DENY the violation, you must contact the clerk’s office on or before appearance date. THE APPEARANCE DATE IS NOT A TRIAL DATE.
Contact may be made in writing, by phone, in person or by attorney. You will be assigned a new hearing date. Clerk’s phone # 812-883-1634.
Traffic Pretrial Diversion Program is handled by the Prosecutor’s office. You must contact Prosecutor’s for this program, 812-883-6560.

VOTER REGISTRATION

The Clerk’s office is in charge of maintaining the record of registered voters in Washington County. Voters may register to vote or pick up the mail in forms at any of the following locations:
In the county clerk’s office.

At the Family & Social Services Center
